Operator: EmoChatLive team, Japan (person responsible: Kaito Onodera / 小野寺 海杜)

Japanese version: 利用規約. The Japanese and English versions are both official. If they differ, the Japanese version prevails for users in Japan and the English version for users elsewhere.

1. Scope

These Terms of Service ("Terms") set the conditions for using the Chrome extension "EmoChatLive" ("the Service") between the operator and you. By using the Service you agree to these Terms. The Privacy Policy is part of these Terms.

2. The Service

While you watch live streams and chats on YouTube, Twitch and Kick, the Service provides, free of charge: visual effects that react to chat activity, template comments, watch records, fan levels, rankings, Oshi Town, and settings sync (if you sign in).

The Service is currently offered in Japan and in the regions listed on the Chrome Web Store.

The Service includes a read-only "mobile view" web page for checking your own records and rankings in a phone browser. Changing records or settings and deleting your account are done in the extension. The mobile view loads records once a day and may differ from the latest state.

2A. Safety notice about visual effects

The Service's effects (such as fireworks, confetti, glowing edges, camera shake, glitch effects and speed lines) may include flashing, bright light, sudden changes in brightness and screen shaking. These may cause eye strain, headaches, dizziness or discomfort. If you are sensitive to visual stimulation or have health concerns, please avoid the effects. You can turn each type of effect off, and turn sensitivity off, in the display settings. If you feel unwell while using the Service, stop immediately and rest. If symptoms continue, consider consulting a medical professional.

3. Unofficial service; relationship with other services

The Service is an unofficial service with no connection to YouTube, Twitch, Kick, or any streamer or agency. It has not been approved by and is not affiliated with any of them. Their names and logos are trademarks of their respective owners. You remain responsible for following the terms and guidelines of YouTube, Twitch and Kick when you use the Service. Changes to those services may cause part or all of the Service to stop working without notice.

4. Who may use the Service

The Service is not intended for children under 13, and people under 13 may not use it. If you are 13 or older but under the age of majority in your country or region, please use the Service only with the consent of a parent or legal guardian. If the laws of your country or region set stricter conditions, you must follow them.

5. Accounts

Signing in (with a Google account) is optional; most features work without it. You must manage your own account and must not lend or transfer it. You can delete your account at any time from the extension's settings page. Deleting it removes your records from our server and cannot be undone. Accounts not used for 24 months may be deleted, as described in the Privacy Policy.

6. Prohibited conduct

7. Rankings

Joining rankings is your choice; by default you do not participate. If you join, your display name and viewing totals are shown to other users who see the same ranking. You can leave at any time. Rankings use only records the server has verified, and records suspected of cheating may be excluded. Display names must not contain words that hurt others, impersonate others or include personal information; the operator may change or hide inappropriate display names.

7A. Oshi Town

Oshi Town is a feature where fans of the same channel place stickers on a shared board and paint a shared canvas. It is not run by the streamer (see section 3). Taking part requires signing in and a record of having watched that channel for at least a server-verified amount of time; looking only requires signing in. Stickers and painted cells are "reservations" that are applied once a day at midnight JST. When several people choose the same spot, the first sticker has priority and the others move to a nearby free spot; a sticker already placed is never removed. Canvas cells take the colour chosen by the most people. You cannot post free text or images, only the available stickers and colours. Section 6 applies; pictures that harass others may be reported in the app and the operator may hide them, exclude the day's result or respond otherwise. The board and canvases are works made together by many users; you agree that the operator may display and keep them in Oshi Town and on the official website. They remain even after you delete your account, with the link to you removed.

8. Features not yet released

Features shown as "coming soon" in the Service are not provided and are outside these Terms. When we start providing them, we will add the necessary terms and announce it on the official website. The scope of the features offered free of charge may change for reasonable reasons (changes to external services, changes in law, security needs, or reviews needed to keep the Service running). We will give advance notice of important changes except in urgent cases.

9. Content you create

Please create template comments, display names and setting images on your own responsibility. If you use images such as background or avatar images, make sure you have the right to use them. These images stay on your own device and are not sent to our servers.

10. Intellectual property

Rights in the Service's program, design, images and text belong to the operator or the rightful owners. These Terms give you the right to use the Service; they do not transfer those rights.

11. Disclaimers and limitation of liability

The Service is provided free of charge and "as is". The operator does not guarantee that it fits a particular purpose, is free of defects, is safe or will remain available. Numbers such as watch time, fan levels and rankings are estimates calculated by the Service, and their accuracy is not guaranteed.

To the extent permitted by applicable law, the operator is liable only for ordinary damages actually caused to you by the operator's breach of contract or tort, and not for indirect, special or consequential damages, except where the operator acted intentionally or with gross negligence. Nothing in these Terms limits any liability that cannot be limited under applicable law, or any rights you have under the mandatory consumer-protection laws of your country or region (including statutory guarantees).

Please resolve any trouble between you and other users or third parties among yourselves.

12. Changes, interruption and ending of the Service

The operator may change the Service or interrupt it temporarily, without prior notice where necessary. The operator may end the Service; if so we will, in principle, announce it on the official website at least 30 days before the end date, except where this is unavoidable (for example when required by law, when an external service stops, or in an urgent security situation).

13. Suspension and account deletion

If the operator reasonably judges that you have violated or may violate these Terms, the operator may, without prior notice, suspend your use, exclude you from rankings or delete your account. The operator's liability in that case is within the scope of section 11.

14. Changes to these Terms

The operator may change these Terms when necessary. We will announce the new content and the date it takes effect on the official website. Important changes that are disadvantageous to you (such as those concerning the handling of personal information) will be announced at least 30 days before they take effect. If you do not agree, you can stop using the Service before that date.

15. Governing law and jurisdiction

These Terms are governed by the laws of Japan. If a lawsuit becomes necessary between you and the operator concerning these Terms, the district court or summary court with jurisdiction over the operator's place of residence in Japan is the agreed court of first instance. This does not deprive you of any right, under the mandatory laws of your country or region (including consumer-protection laws), to bring a claim in another court or to rely on those laws.
